CPD event: Reflections on Gao Hai Yan v Keeneye Holdings and Med-Arb in Hong Kong (2018)

The Talk will consider the impact (if any) of the Court of Appeal's decision in Gao Hai Yan v Keeneye Holdings [2012] 1 HKLRD 627 on the use of mediation-arbitration (“med-arb”) in Hong Kong as a mode of dispute resolution. It will also discuss whether it makes sense to promote med-arb in Hong Kong, especially in light of the DOJ looking into the possibility of a greater use of evaluative (as opposed to facilitative) mediation here.
